An intervention petition has been filed in the Supreme Court against bringing marital rape under the ambit of crime. In the petition, the arguments demanding criminalization of marital rape have been opposed. The petition states that the misuse of gender-based specific laws is a matter of concern. Criminalizing marital rape would destabilize the institution of marriage and family in India.
Several gender-based laws have been cited in the petition and how these laws are being misused on a large scale. In the petition, there has been a demand to dismiss the petitions demanding that marital rape be brought under the category of crime.
The Supreme Court will hear from March 14 on the demand to bring Marital Rape i.e. forcible sex of husband with his wife under the ambit of rape. The Supreme Court has asked the Center to file its reply in this matter by February 15. Is marital rape a crime on last year i.e. 16th September 2022 or not? The Supreme Court agreed to examine this.
