National Desk:
Rahul Gandhi's parliamentary membership has also been terminated after he was convicted by a court in a defamation case.  Kerala's Wayanad MP Rahul Gandhi has been disqualified from the Lok Sabha.  This is considered to be the biggest blow ever for Rahul Gandhi.  Rahul has also been given a notification issued by the Lok Sabha in this regard.  On Thursday, the court sentenced Rahul Gandhi to two years in jail.  Now the question arises whether Rahul Gandhi will not be able to contest the 2024 Lok Sabha elections?
The Representation of the People Act contains provisions regarding disqualification.  Section 8(3) of the RP Act states that a person convicted of any offense shall be disqualified from the date of conviction if sentenced to imprisonment for at least two years.
In addition, the person will not be able to stand for election for a period of six years after serving his sentence.
The Lok Sabha Secretariat has issued a notice of disqualification to Rahul Gandhi, making it clear that his seat in Wayanad is now vacant.
The disqualification will continue for 6 years after their release, which means they can be disqualified for a total of 8 years.
The Congress, meanwhile, has said it already realized this.  For this we have to know about the Representation of the People Act, according to the Representative of the People Act, if MPs and MLAs have been sentenced to more than 2 years in any case, their membership (from Parliament and Assembly) is cancelled  will go.
