The Supreme Court has said that unmarried women in India also have the right to abortion under the MTP Act.  The Supreme Court has said that all women in India have the right to choose.  The meaning of this decision of the Supreme Court is that now even unmarried women have got the right to abortion up to 24 weeks.  SC has extended Rule 3-B of Medical Termination of Pregnancy Rules.  Let us tell you that in normal cases, the right of abortion of pregnancy more than 20 weeks and less than 24 weeks was till now only married women.
The Supreme Court in its judgment said that the right to freedom of reproduction, dignity and privacy under Article 21 entitles an unmarried woman to the same child as a married woman or not.
The court said that prohibiting single or unmarried pregnant women having a pregnancy between 20-24 weeks from abortion while allowing married women in such a situation would be violative of the spirit of Article 14 of the Constitution.
 The court interpreted the MTP (Medical Termination of Pregnancy Act) Act to say that a woman's marital status cannot take away her right to terminate an unwanted pregnancy.  Whether a woman is married or unmarried, she has the right to an abortion up to 24 weeks of pregnancy under the MTP Act.
 The court said that rape includes marital rape to establish the object of abortion.
