The Supreme Court on Wednesday (November 13) delivered a landmark judgment in the bulldozer action. The court said no government can take bulldozer action at will. Notice must be given prior to action stating why and how the property against which action is being taken is illegal. The action should also be informed to the district administration.
The court also said that if the house or building has been demolished by wrongful action, compensation should be paid and action can be taken against the government official. The court said that someone's house cannot be broken into just because they are involved in a criminal case or are accused or convicted. Bulldozer action taken in disregard of the law is unconstitutional. The Supreme Court said that directives can be issued to the executive to protect fundamental rights and realize statutory rights.
