Supreme Court On Retired Judges: The Supreme Court on Wednesday (September 6) dismissed a petition seeking to bar Supreme Court and High Court judges from taking political office for two years after retirement.
The court said the matter should be left to the discretion of the retired judge. The court further said that it could not issue such an order. It is the government's job to make laws.
The petition of the Bombay Lawyers Association said that this was necessary to maintain the independence of the judiciary and public confidence in the judiciary. The petition mainly cited the example of Andhra Pradesh Governor Justice S Abdul Nazir. Justice Nazir was a member of the bench that decided the Ayodhya case.
"It seems that you have a special objection to a judge," said Justice Sanjay Kishan Kaul, president of the bench hearing the case. Counsel Ahmed Abdi, appearing for the petitioner, said he was speaking out in the interest of the judiciary.
The judges said there are many tribunals where only former judges can be appointed by law. As far as contesting elections or taking any political office is concerned, the Supreme Court will not issue any order. This matter should be left to the discretion of the judge concerned.
In the past few years, two Supreme Court judges have become governors a few months after retirement. While a former Chief Justice Ranjan Gogoi is currently a member of the Rajya Sabha at the moment.
