Supreme Court decisions and arguments will no longer use gender stereotypical terms. The top court has asked women to refrain from using offensive words. They have also issued handbooks for what words can be used as substitutes.
The Supreme Court on Wednesday launched a handbook for tackling gender stereotyped terms to help judges avoid using inappropriately gendered terms in court orders…. Launching the handbook, CJI DY Chandrachud said it contains a list of offensive words and what words should be used instead. They can be used to argue in court, make orders and prepare copies.
The CJI said the purpose of preparing this handbook is not to criticize or cast doubt on a decision, but to point out that there is a tradition of conservatism, knowingly or unknowingly. The court aims to explain what stereotypes are and what the harms are so as to avoid the use of offensive words against women.
For example, it is not appropriate to call a woman an adulteress. Instead, it can be said that a woman who has engaged in extramarital sexual relations. The use of the term affair in court orders may be replaced by extramarital affairs. It is also inappropriate to call the wife a dutiful wife, she should be called a woman.
